One gets the impression, nowadays, that the concept of the rule of law is, among Western intellectuals, a concept intellectually isolable, like a chemical element, and then fungibly distributable, or imposable, across and into all civilizations.
 
I am skeptical that that is the case. My skepticism relates to the relationships I have been discussing between law and other features of societies, such as customs, language, racial characteristics, traditions of various kinds, class structures, religious institutions and practices, and other things.

Certainly what Talleyrand had meant, in the squib above, at Vienna, by 'the rule of law' was not a concept which might be exported anywhere else but within Western Europe, and perhaps Russia, around 1815.

SEVERAL THINGS THE WEST SHOULD HAVE LEARNED DURING THE COURSE OF THE DEMOCRATIC REVOLUTION

You don't enslave members of foreign civilizations and races, and then import them into where you want to live. Enslaving them where they are is fine.
 
You don't indenture them as servants within your own civilization, but it is fine to have them as servants while you are in theirs.
 
You don't accept too many, of any kind, race, religion, or ethnicity, as immigrants, ever.
 
One classic example of how this was considered best practice by a great power was Spain up to 1492. It had expelled the moors and the Jews by that date. That probably was considered by them a great success: 'Let them determine themselves somewhere else!'

Of course, a whig interpretation of history will find terrible problems with this course of events, but that is Whig history for you.

RE KRUGMAN nyt WHAT'S THE MATTER WITH EUROPE?


The same thing that's been the matter with us, here, since before 1776:  lack of a firm sense anymore, for Western Civilization as a cultural value, based on religion, class distinctions (however you describe them) and accompanying social order, race as an underlying civilizational feature,  and based on both local national and civilizational history, millenia of it really. 
 
Krugman, on what he pejoratively calls French white nationalism: 'Let's stop dignifying this stuff by calling it populism.' I agree, but let's go on along this line of reasoning....
 
I am not going to use the term populism, either, because it has meaning, mostly historically, only as a pejorative term, usually used by the then upper class or the conservatives within it, that no longer exists, referring to a lower class movement or issue.
 
I am going to dignify it, so called French white nationalism, by something more important, assuming for a moment that this may be the impulse from which it springs, both in France, England, and elsewhere in Europe: Western Civilizationalism. 

It is against what one might call EUism, a globalist openness to every civilization, color, and creed in the world so long as they are a heavy hitter, a tamping down of mere European nationalisms, Western religion, and western ways, everywhere, in favor of an overarching global paradigm. He nevertheless criticizes the EU for tamping down its small states, but what alternative is there to get to that great utopian goal he shares with the EU ideal?
 
Krugman doesn't want anything like Western Civilizationalism to keep rearing its head in either Europe or here.
 
He is an economic, cultural, and civilizational globalist. Almost all so called liberals are, under the skin.
 
Most liberal intellectual Jews are, too, and always have been: they were forced to it by Christianity over many centuries. They are mostly against something like Zionism, something only conservative Jews venerate, and which began with the  neocon movement here.
 
He doesn't care what your color is, what your religion is, what your standard of living is, what your race is, what your political beliefs are: you are his audience.

DAVID BROOKS THE CRISIS OF WESTERN CIV ARTICLE APRIL 21

Why not just go almost line by line?
 
His first few lines, Will and Ariel Durant... 

I read parts of it when a kid. This is a classic of the Whig Interpretation of History, which I have discussed recently here, the theory of confident and progressive Western history which Brooks likes, and which he laments is dying in America and elsewhere in the West. More on that issue later.
 
Next, he says this story of civilization came with certain values, such as reasoned discourse...

 Well, what does reasoned discourse really mean; presumably a multitude of diverse and inconsistent things and disciplines, notoriously difficult to get a handle on, bleeds over into ethics, logic, mathematics, history, politics, you name it.

Well, what else did reasoned discourse itself also come with, one might ask? I will tell you: it came with a gnawing sense of skepticism about the powers of reason and perception themselves to see or understand reality in itself. 

In other words it reiterated an ancient tradition from the Greek Fifth Century Enlightenment about the elusiveness of knowledge asserted the relativity of all values, traditions, factual truths, and religions. 
 
He claims Western Civ set a standard for great statesmanship. 

What can he mean? Moral statesmanship, whatever that means? Does he mean ancient Greek and Roman statesmen, Pericles, Alcibiades, Cicero, the Gracchi, Caesar, the ones he likes; good practitioners of raison d'etat; balance of power expertise; Machiavelli, perhaps Bismarck, Richelieu, Hitler? He doesn't say. Wouldn't it also however have correspondingly set a standard for terrible statesmanship? Otherwise, how would one know what great was? So, let's just say that maybe the West set both kinds of standards and all degrees in between.
 
He next mentions a town square, and religion, in passing. 

Under Brooks' whig interpretation, the Reformation and Counter Reformation were milestones in this Whig narrative of the confident march toward the progress of today. Butterfield described it very well.  
 
Next, he mentions giving diverse people a sense of shared mission, common vocabulary, common goals. 

This started out as an aspiration only intended within and among diverse peoples of only the West itself. Even other countries within the West were viewed by each as in a sense barbarians, even into the 19th Century; how much more so, denizens of other civilizations. but this sense of shared mission, common vocabulary and goals, eventually became, by the force of Western ideology itself sua sponte, the dream of some Western liberals in the 18th and 19th centuries to include all people of the world.
 
It had seldom been part of the Western civ concept before that time, except perhaps in terms of early Christianity being spread as a Jewish mission to the gentiles, presumably ultimately to all the gentiles in the world regardless of race religion or civilization. The idea of course had become popular among all religions which sought to convert infidels in conquered lands rather than to kill, enslave, or exile them.

Brooks then explains how this crisis of Western Civ began. It only began several decades ago he says. 

I may come back to that point directly at some point below in discussing other points here.

He blames this relatively sudden civilizational crisis on academia, an institution conveniently other than journalism. 

He can't very well blame journalism, too, can he?

Journalism's mission, apparently, after all, is presumably not to try to weigh in on such issues with scholarly authority in the first place anyway. Although, isn't that rather what Brooks does here himself in blaming academia, or am I missing something?

Remember that Brooks himself assured us a while back that we had finally, for several decades now (coincidentally, the ostensible length of the evolving civilizational crisis he decries), reached the stage of a meritocracy here in America. 

Presumably, however, the emerging meritocracy here would also have some things to do, at some points, with academic excellence and standards, and be somehow connected with a concept of Western civ as itself a meritocratic concept, no?

So, how according to Brooks, are we both finally a meritocracy founded on mainly academic excellence and expertise, and also in a sudden crisis of Western civ brought on by academic waywardness and incompetence? How?

Following up on this prior post and vexed group of issues, I have tried in various posts since this one to set the stage regarding how one might think about such things.

There are those who will say that 'civilization' is artificial, or that religious distinctions are artificial in light of other similarities across religious lines. 

They might suggest that class distinctions, whether based on religion, or wealth, or tradition, or other things as well, are artificial.  Fair enough. That is their view.

Racial differences are apparent, yet race differences are an artificial category of distinction in isolation from other differences and similarities. Race, culture, religion, and civilization tend to be more, or less, loosely related.

RACE COLOR AND CIVILIZATION

"If slavery was accepted, there was a general feeling against enslaving Greeks, and most slaves were obtained, by war or raids, fron non-Greek countries. In this way the question of slavery was connected in the Greek mind, as in the American, with that of racial inferiority." Guthrie, III, p 156
 
There are several things about this passage, and about this account, to note.
 
One thing to note is that the Greeks tended to equate nationalism, or civilizationalism, not just city-statism, with race, although it seems that Greeks could and did enslave other Greeks, I guess. It was frowned upon.
 
Another thing to note is that the concept of race itself, for the ancient Greeks, had nothing to do with skin color, much less physical differences which modern people also consider racial characteristics.

Guthrie's comparison, between ancient Greeks amd modern Americans' views of the meaning of race, is troubling, because although as he means that slaves were also mostly foreigners among Americans, they were also identified, most crucially, by the skin color and physical features, criteria absent from the ancient Greeks' criteria:

"The complaint of the Old Oligarch is well known: slaves at Athens are an insolent lot who will not get out of your way in the street, and you are not allowed to strike them for the simple reason that there is nothing in their dress and general appearance to deistinguish them from free Athenians." Guthrie, III p. 156  
 
For the Greeks, race was a civilizational criterion, since they considered even white non-Greeks as members of a different race, as barbarians. Non-Greek whites were a different race because they were barbarians, not because their skin color was different, or because their physical features differed from Greek ones. 
 
Language, customs, dress, and religion presumably identified someone, racially, as Greek or non-Greek, not skin color or physical features, but the slaves in Athens apparently dressed and looked like Greeks.

It doesn't matter what (or how many, colors) your skin color is. You could be polka dot, or mottled, or albino.

It matters nothing what your sexual orientation or gender is, or frankly whether you have any. It means nothing, big picture, to pure globalization:better if you have none, frankly!

It doesn't matter what country or civilization you're associated with or are a part of, as a citizen or a refugee.

So, after reviewing the above posts, where to go from there? '...The implications for religion'.
 
Because religion, across the broad distinctions of world faiths, not of Protestant versus Catholic in the West, or of Shiite versus Sunni in Islam, or of types of various sects within Buddhism or Hinduism, has normally had at least a strong racial dimension, has been based on broad and general racial distinctions throughout the world, and also has been associated with societies in which religion and government have often been closely identified if not identical, the emergence of a globalist ideology which cuts across these distinctions renders religion itself an abomination.

For the globalist, all religions, including any sectarian creed within any particular religion, however so called moderate, are as contrary to globalism as the concepts of distinctions of race, of ethnicity, and the existence of the long detested nation state. 

Distinctions of gender follow in train, of course. The thoroughgoing globalist must look past not only actual racial differences, but also declare gender ones contrary to idealized universal human rights. 

He must, furthemore, declare all religions, of whatever kind or degree, contrary to human rights and to the rights of man.

The distinction of a separation of church and state is obsolete because both the church, any church, and the (nation) state, are obsolete for the thoroughgoing globalist, and frankly inimical to globalism."

Where to begin? Once you challenge the very notion of racial differences being a natural, or neutral, even an inherently good thing,  you come up against other related organizing principles for societies, such as religion, government, and civilization.
 
Separating church from state, fallout from The Reformation Fallacy, has turned out to be another thin wedge of a broader Western assault on social and political reality as it had always been.
 
Separating church from state, was then, eventually, only in the later 19th Century and only in the West, combined with a completely new, and quite radical, uniracialism, call it the racial and political brotherhood of man, so to speak, into a powerful new multidimensional globalist vision, quite apart from the economic globalism of Smithist laissez faire, already taking over in the West since the late 18th Century, which also played right into globalism.

POLITICS LAW AND PHILOSOPHY SUBSTANCE PROCEDURE SEPARATION OF POWERS FOIBLES

Let's just say a few more words about separation of powers, and a few other little things.

SOP gets broken down by what are called powers.

These, in turn, get classified, here, in some cases, in some states I don't know how many, as being distinguished by whether they are substantive or procedural, whatever you take those terms to mean, but they do have a history.

Thus the judiciary sometimes takes the stand that it does, or should, have more or less complete authority over procedural matters, as a very constitutional matter, whereas the legislature, or the executive, should rule over substantive matters, and/or over other matters as well, classified also in other ways not inconsistent with this fundamental substance procedure distinction itself.

That is where it seems to stands, it seems. The relationship between the branches itself has a history. The substance procedure distinction itself seems to me not to be original with the political or philosophical thinking of the founders. The role of the judiciary itself seems also to have grown over time, apart from how its power is and has been characterized vis a vis other branches.
 
That is why the Daubert versus Frye debate, in Florida and perhaps in other states, takes on a more important aspect. It represents a jurisprudential as well as a political debate about the relationship between the branches, based on differing conceptions of what the fundamental nature and scope of powers of the branches themselves, in relation to each other, really is or should be.

I don't really want to get into the philosophy underpinning separation of powers, or the substance procedure distinction, here, but rather merely to point out what may be at stake, for other, non philosophers, readers, in this discussion.

Postscript: Just a couple of observations:

Hitler did what DK accuses him of under color of German democratic law. That is one huge observation.

Here is another: Hitler turned various erstwhile liberal Weimar bureaucracies to his purposes, just as Trump and his predecessors have done here.

Here is a third: Hitler actually had an elaborate political cultural military and economic program for Germany. Trump, believe me, has none for America, and neither have either his Democratic or Republican predecessors. They have had no program.
