 The use of convict labourers on overseas projects is damaging China's 

China has devised a novel strategy to relieve pressure on its overcrowded prisons: employ convicts as labourers on overseas projects in the developing world. [See footnote: Chinese response] The practice has exposed another facet of China's egregious human rights record which, when it comes to the overseas operations of Chinese companies, includes the government's failure to enforce its own regulations.

China executes three times as many people every year as the rest of the world combined. Amnesty International has estimated that, in 2007, China secretly executed on average "around 22 prisoners every day".

In addition to being the world's leading executioner, China has one of its largest prison populations. The 2009 world prison population list compiled by the International Centre for Prison Studies at King's College London, put the total number of inmates in Chinese jails at 1.57 million – larger than the population of Estonia, Guinea-Bissau, Mauritius, Swaziland, Trinidad & Tobago, Fiji or Qatar.

The forced dispatch of prisoners to work on overseas infrastructure projects raises new issues regarding China's human rights record. It also adds a new element – the dumping of convicts – to its trade and investment policy, which has been much criticised for dumping goods.

Thousands of Chinese convicts, for example, have been pressed into service on projects undertaken by state-run Chinese companies in Sri Lanka, a strategically important country for China as it seeks to enhance its regional position in the Indian Ocean. After providing Sri Lanka's government with offensive weapon systems that helped end the country's decades-long civil war, China has been rewarded with port-building, railroad, and other infrastructure projects.

Chinese convicts also have been dispatched to the Maldives, where the Chinese government is building 4,000 houses on several different islands as a government-to-government "gift" to win influence. So far, however, China has failed to persuade the country's president to lease it one of the 700 uninhabited Maldivian islands for use as a small base for the Chinese navy.

Chinese companies' operating practice for overseas projects, including in Africa, is to keep the number of local workers to a bare minimum and to bring in much of the workforce from China, some of which comprises convicts "freed" on parole for project-related overseas work. Convict labourers, like the rest of the Chinese workforce on such projects, are housed near the project site. That way, if any convict worker escaped, he would be easy to find in an alien setting.

In theory, such practices run counter to regulations promulgated by the Chinese commerce ministry in August 2006, in response to a backlash against Chinese businesses in Zambia following the death of 51 Zambian workers in an explosion at a Chinese-owned copper mine. These regulations called for "localisation," including hiring local workers, respecting local customs, and adhering to safety norms. During an eight-nation 2007 African tour, Chinese President Hu Jintao made a point of meeting with Chinese businesses to stress the importance of corporate responsibility in their local dealings.

Moreover, in October 2006, the state council – China's cabinet – issued nine directives ordering that Chinese overseas businesses, among other things, "pay attention to environmental protection", "support local community and people's livelihood cause" and "preserve China's good image and its good corporate reputation".

But Chinese regulations are sometimes promulgated simply to blunt external criticism, and thus are seldom enforced, except when a case attracts international attention. For example, in 2003 China enacted a law on environmental-impact assessments, which was followed in 2008 by "provisional measures" to permit public participation in such assessments. Yet Chinese leaders remain more zealous about promoting exports and economic growth than in protecting the country's air and water.

Similarly, the state council's 2006 nine directives to Chinese overseas companies have been subordinated to the drive for exports and growth, even when it imposes environmental and social costs on local communities abroad. Indeed, as part of the government's "going global" policy, Chinese companies are offered major incentives and rewards for bagging overseas contracts and boosting exports.

The use of convict labourers adds a disturbing new dimension to this strategy. But even before convicts became part of China's overseas development effort, some Chinese projects, especially dam-building schemes, were embroiled in disputes with local communities in Botswana, Burma, Pakistan, Ghana and Sudan. In fact, several small bombs exploded less than three months ago at the site of Burma's Myitsone dam, whose construction by a Chinese company in insurgency-torn Kachin state is displacing thousands of subsistence farmers and fishermen by flooding a wide swath of land.

Chinese companies cannot get thousands of prisoners released on their own, let alone secure passports and exit permits for them. It is obvious that the practice of pressing convicts into service on overseas projects has been instituted at the instance of the Chinese government.

Until the Chinese government's treatment of its own citizens and those of other countries is guided by respect for basic human rights and the rule of law, China is unlikely to command the respect that it seeks on the world stage.

I am writing in reference to the comment "China's newest export: convicts" written by Brahma Chellaney, in the Guardian dated 29 July, which claims that convicts are employed as labourers on overseas projects in Sri Lanka, Maldives and countries in Africa and that Chinese companies had been doing so at the instance of the Chinese government.
It should be noted that the author made such shocking and sweeping allegations without any evidence. His allegations are both unfounded and totally untrue. Under China's law, criminal convicts are prohibited from travelling abroad and Chinese companies are not permitted to hire people with criminal records to work on their overseas projects. These regulations are strictly enforced in practice.

China overtakes US as EU's biggest trading partner


China is now the EU's biggest trading partner, overtaking the US in 2020.

China bucked a wider trend, as trade with most of Europe's major partners dipped due to the Covid-19 pandemic.

Trade between China and the EU was worth $709bn (€586bn, £511bn) last year, compared with $671bn worth of imports and exports from the US.

Although China's economy cratered in the first quarter due to the pandemic, its economic recovery later in the year fuelled demand for EU goods.

China was the only major global economy to see growth in 2020, stoking demand for European cars and luxury goods.

Meanwhile, China's exports to Europe benefited from strong demand for medical equipment and electronics.

"In the year 2020, China was the main partner for the EU. This result was due to an increase of imports (+5.6%) and exports (+2.2%)," according to Eurostat, the EU's statistical office.

The figures were similar to China's official data published in January, which showed trade with the EU grew by 5.3% to $696.4bn in 2020.

The EU's trade deficit with China also grew from $199bn to $219bn according to Eurostat figures, which were released on Monday.ugh the US and the UK remain the EU's largest export markets, trade with both countries dropped significantly, the statistics showed.

"Trade with the United States recorded a significant drop in both imports (-13.2%) and exports (-8.2%)," the data agency said.

Transatlantic trade has been hit by a series of tit-for-tat disputes that have resulted in tariffs on steel and products such as French Cognac or American Harley-Davidson motorcycles.

In 2020, the US had a trade volume of $671bn with the EU, down from $746bn the previous year.It is not year clear if new US President Joe Biden will re-evaluate the US approach to trade with Europe.

The EU and China, however, are trying to deepen their economic ties, with both sides seeking to ratify an investment deal that would give European companies better access to the Chinese market.

Analysts are tipping global trade to turn around in 2021 after a lacklustre 2020.

The real value of global trade is set to rise by 7.6% after an an estimated contraction of 13.5% in 2020 to $16.4tn, according to research firm IHS Markit.

Current or former police officers and military personnel were prominent in the front lines pushing back the barricades, and among those who got inside. Later investigations concentrated on persons identified by photos and videos or their own on-line posts; among these about one-fifth of the hundred or so investigations were police or military. Most prominent of all was Ashli Babbitt, veteran of many deployments in Iraq, who was a security officer (i.e. military police) in the Air Force.

 

Two comments: first, it is typical in riots that the great majority of the crowd are onlookers and noise-making supporters; only about 10 percent or less of the persons seen in riot photos are actually doing something violent, engaging the other side. It may well be the case that those who carry the battle are specialists in violence, as Charles Tilly calls them, tough guys, athletes and weapons specialists on either side of the law. (One of those charged at the Capitol was an Olympic gold-medalist swimmer.)

 

Second: in the overall context of recent years and months, it is not surprising that some substantial portion of American police, as well as military, are disgruntled. Among veterans and active-duty military, the suicide rate has been at a peak; the psychological toll of fighting for almost 20 years in seemingly endless wars in the Middle East; a professional (non-draftee) force repeatedly deployed, isolated from the majority of the home population; wars where victories repeatedly proved temporary and reversible; and where news publicity concentrated more on atrocities against the enemy than on American accomplishments. Since a substantial portion of police are veterans (the job where their training is most relevant), there is a bond of sympathy between the two occupations.

 

The police themselves have experienced the historically strongest wave of criticism in the media and from liberal politicians. Starting in the 1990s when amateur video of violent police arrests became publicized, protest has accelerated with the proliferation of mobile-phone cameras, CCTV, and near-instantaneous propagation through the Internet. Police shootings and violent arrests have resulted in a series of protest demonstrations nationwide periodically dominating the news cycle since Ferguson, Missouri in 2014, Baltimore in 2015, and others. The most intense protests were those starting in late May 2020, in the midst of dissention over the COVID shut-down; these were the most widespread and long-lasting ever, extending into September and beyond in hot spots such as Seattle and Portland. More than in any previous protests, most news media supported these Black Lives Matter protests and related actions; publicizing and endorsing their calls to defund the police; blaming local police for racism; blaming violence on Federal intervention by the Trump administration; downplaying arson and attacks on police stations, courthouses, and government buildings. Many police felt they were being unfairly blamed for the actions of a few, with little understanding for doing a tough job in a period of sharply rising homicide in minority neighbourhoods.


In the context of an election campaign, both parties rallied to the issue: Democrat politicians on the whole endorsed BLM demands for whole-sale revision not only of policing but the historical legacy of slavery and racism. A wave of tearing down Civil War statues of Confederates expanded into renaming and expunging almost anyone in US history who could be implicated in slave-holding, words or deeds detrimental to Native Americans, or European settlement of North America in general. These included Benjamin Franklin, Thomas Jefferson, Andrew Jackson, Abraham Lincoln, Ulysses Grant, and Teddy Roosevelt. In June 2020, in the midst of the protests over the death of George Floyd, the Democrat controlled House of Representatives voted to change the District of Columbia into a state renamed Douglass Commonwealth, replacing Christopher  Columbus with the abolitionist Frederick Douglass. Corporations were pressured into re-education programs at which employees were told to avow their guilt in being white.

Although The Senate is empowered to decide questions of impeachment, I would argue that they are not empowered to decide questions of constitutional interpretation.

The question they decided today is not one which the Senate could have or should have decided, but rather should have referred to the Supreme Court for decision prior to going forward.

it was not set up to function as a judicial tribunal, or to decide questions of law as such, much less questions of law on constitutional interpretation.

It is hardly the kind of question which should have been disposed of by a vote, which is normally reserved for the kinds of questions juries are called to decide as questions of fact, not of law, much less of constitutionla interpretation..

if the Senate should decide this question of constitutional interpretation by vote, then why shouldn't it decide all such questions by vote and dispense with the Supreme court altogether?

Unfortunately, this passage has problems in various ways.
Just to take one of many ways:

The Missouri Compromise had already been repealed by Kansas Nebraska years before Dred Scott. I would call this legislative jurisprudence, rather than a jurisprudential activist great exception.
