He also discusses the liberal elite, which functioned, domestically and judicialy, similarly to how the same political elite in the other branches functioned globally:
"...If in fact a conservative justice is appointed, it will, I think, mark the end of an era that began in 1954. During the next six and a half decades, an educated elite used the court system to turn its values on a number of key issues into national policy. Don't misunderstand me, I am a charter member of that educated elite myself, and on most issues those values are my values as well. But there has never been a real consensus around many of them in the country at large, and the attempt to impose them has had a lot of very negative consequences...." DK
As he admits, it was hardly a judicial consensus.
I would just add, not a lasting consensus, in any branch, ever.
