RE WITTGENSTEIN AND JUSTICE PITKIN WINCH AND THE LAW

This is an interesting journalistic tour through some modern analytic philosophy and social scientific theory.


She follows Cavell, and in my judgment is much too quick to try to find fault with Winch's ideas, lumping him in with positivists, which he certainly was not.  


She also incidentally seems to benefit, as she goes along in this work, not just from Wittgenstein's ideas, but also from many of Winch's.


None of this of course has virtually anything to do with any actual practical applications in the legal system.  


It has much more to do with social scientific theory, but at least she is willing to struggle with issues across multiple disciplines, an almost lost art.
