This has become a hot topic over the past 10 or 20 years.
Property lawyers discuss challenging projects done this way.
That is not my topic in discussing it, for or against challenging this or that project done that way.
Design build is a bad idea, especially for public projects. I am not talking about a project for a public toilet in a public park, but larger more complex or environmentally challenging projects, the kind that property rights lawyers would take an interest in because they require taking private property.
The property rights bar and lobby probably does not want to talk about it that way.
They want to get their fees by cleverly obstructing projects, not really, necessarily, stopping them (except in those states where they get really really big fees for that), but delaying or even converting them from design build, I suspect, merely to wring monetary concessions, especially their fees, out of condemnors.
