Contrary to Jordan, bondage was hardly vestigial even in the mid 18th Century in Britain, and it is a Whig fallacy to argue that actual practice in Britain outran ostensible early liberal legalities prohibiting bondage.
When for example the crown put someone in bondage well into in the 18th Century, they certainly did so under color of law.
Half the people who came here were bondsmen, many had been kidnapped.
