I would have gone straight to a competency hearing, a thing I seldom resorted to, trust me.
It's complicated to explain.
It may be that she ordered her public defender, a role I used to play, not to even consider questioning her mental state in order to try to help her get a usable defense. They seldom or never want to be thought incompetent.
I had prosecutors, people I liked and worked with, joke that I often didn't even know that my client was loony tunes. It was an inside joke, trust me.
Let's put it this way: What prevented them, the prosecutors, who came out of the box with all the evidentiary cards in every case, from suggesting a competency evaluation?
You may have thought that the state would have had an interest in not prosecuting or going to trial for cases where the defendant was insane but no insanity was suggested by anyone.
I never heard them make such a request.
